1. Introduction

These Terms of Service (Terms) govern your use of HypeMarket at hypemarket.ai (the Service). HypeMarket is operated by Yaroslav Shmarov, an individual based in Warsaw, Poland (we, us, our).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of service

HypeMarket is a platform that connects brands with content creators. The Service allows:

  • Organizations (brands) to create collabs (collaboration opportunities), discover creators, review submissions, and manage creator partnerships
  • Creators to connect their social media accounts, showcase their audience analytics, browse and apply for collabs, and receive payouts for completed work

The Service integrates with third-party platforms (YouTube, TikTok, Google) to display social account statistics and analytics.

3. Eligibility

To use the Service, you must:

  • Be at least 16 years of age
  • Provide a valid email address
  • Have the legal capacity to enter into a binding agreement

We reserve the right to refuse service to anyone for any reason.

4. Your account

  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity that occurs under your account
  • You must provide accurate and complete information when creating your account
  • You must not create multiple accounts for the same person
  • You must notify us immediately if you suspect unauthorized access to your account

5. Social account connections

The Service allows you to connect social media accounts (YouTube, TikTok) via OAuth. When you connect a social account:

  • You grant us read-only access to your public profile information and channel/account statistics
  • We use this data to display your analytics, track growth over time, and facilitate creator-brand matching
  • We store OAuth tokens securely (encrypted at rest) and use them only to fetch updated data from the platform APIs
  • You can disconnect any social account at any time from your social accounts page
  • We recommend also revoking access from the respective platform's settings

We do not post content, modify your profiles, or take any write actions on your connected social accounts.

6. Subscriptions and payments

  • Paid features require an active subscription
  • Subscriptions are billed on a recurring basis (monthly or annually) through Stripe
  • You can cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period
  • We do not store credit card numbers or bank account details on our servers — all payment processing is handled by Stripe
  • Creator payouts are processed through Stripe Connect. Stripe may collect additional identity and banking information directly from creators

Prices are listed in the Service and may change with notice. Refunds are handled on a case-by-case basis — contact us at hello@hypemarket.ai.

7. User content

User content includes any text, images, files, or other materials you submit to the Service (collab descriptions, submissions, profile information, uploaded files).

7.1 Content submitted to the platform

  • By submitting content to the Service (profile information, collab descriptions, etc.), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely as necessary to provide the Service
  • This license ends when you delete the content or your account

7.2 Collab content created for brands

When you accept a collab and create content for an organization (brand), the following applies unless the collab specifies different terms:

  • You grant the organization full, exclusive, worldwide, perpetual, royalty-free ownership and distribution rights to all content created as part of the collab (Collab Content)
  • The organization may use, reproduce, modify, distribute, and display Collab Content across any media and channels without further permission or compensation beyond the agreed collab payment
  • You are responsible for distributing Collab Content through your own social media channels as specified in the collab brief
  • You represent that Collab Content is original, does not infringe any third-party rights, and that you have full authority to grant these rights

Individual collabs may include specific terms that override these defaults. In case of conflict, the collab-specific terms take precedence.

7.3 General content rules

  • You must not submit content that is illegal, infringing, defamatory, obscene, or otherwise harmful

We reserve the right to remove content that violates these Terms.

8. Prohibited conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Scrape, crawl, or use automated means to access the Service without our permission
  • Create fake accounts or misrepresent your identity
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use the Service to send spam, phishing, or unsolicited messages
  • Circumvent any security measures or access controls
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell or redistribute the Service without our permission

9. Intellectual property

  • Our property: The Service, including its design, code, branding, and documentation, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.
  • Your property: You retain all rights to the content you submit. We claim no ownership over your content.

10. Termination

  • By you: You can delete your account at any time from your account settings. This permanently removes your data as described in our Privacy Policy.
  • By us: We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. We will make reasonable efforts to notify you before termination, except where immediate action is necessary (e.g., fraud, security threats).

Upon termination, your right to use the Service ceases immediately.

11. Disclaimer of warranties

The Service is provided as is and as available without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Social platform data will be accurate or up to date (data depends on third-party APIs)
  • The Service will meet your specific requirements

12. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (e.g., liability for fraud or gross negligence).

13. Governing law and disputes

These Terms are governed by the laws of Poland. Any disputes arising from or related to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Warsaw, Poland.

If you are a consumer resident in the EU, you also have the right to bring proceedings in the courts of your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through an in-app notification at least 14 days before the changes take effect.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the updated Terms, you may delete your account.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
